Amazon is facing a class action lawsuit filed by customers in Seattle, who are seeking refunds for increased product prices due to tariffs implemented under the Trump administration. The lawsuit, first reported by Reuters, alleges that Amazon profited “hundreds of millions of dollars in unlawful tariff costs.”

The legal action follows a 6-3 decision by the US Supreme Court that ruled against the legality of the tariff policy. This decision allows corporations to recover restitution for tariff costs. Several companies have confirmed receiving refunds from the US government, but the lawsuit claims that Amazon has not participated in this refund process.

The plaintiffs assert that Amazon’s decision not to engage in refunds is an attempt to “curry favor with Trump” by enabling the government to retain the funds. The complaint states, “Amazon has not returned any portion of those costs it passed on to consumers, and it has no intention of doing so,” further claiming that the online retailer has retained a windfall from unlawful government action.

Shipping companies affected by the tariffs, including DHL, FedEx, and UPS, have begun the process of issuing refunds and are passing the proceeds on to impacted customers. Meanwhile, Nintendo has taken action against the US government by filing its own lawsuit regarding the tariffs it incurred to import its products into the country. Amazon has been contacted for comment on the lawsuit.
